As the legalization of cannabis for medical or recreational use continues to spread across the nation, NABCA is tracking the changes in policy surrounding cannabis and its derivative products, such as hemp and THC beverages. The following dashboards show the definitions, permissions, and regulations surrounding these products.
Cannabis Legal Status
Cannabis is a plant that produces intoxicating THC. Beginning with California in 1996, the legality of medical cannabis spread across the United States, and after Washington became the first state to legalize recreational cannabis in 2012, more states began to permit the retail of recreational cannabis. This dashboard shows the legality of recreational cannabis and medical cannabis, and the tooltip shows the taxation rate, the regulatory oversight department, whether it can be delivered, and whether local jurisdictions retain oversight. This data is collected via review of state legislative code and regulations. (Updated Nov 2025)
THC Beverages
THC beverages are drinkable single-serve intoxicating products that have begun being retailed in the US under hemp and recreational THC provisions. This dashboard shows the presence of a THC beverage definition in the statute of each sate for the purposes of taxation and retail and will be expanded to include concentration limits, location of retail, and regulatory restrictions. This data was collected through review of state legislative code and state regulations. (Updated Nov 2025)
