NABCA is monitoring emerging trends in alcohol policy, tracking changes to permissions, definitions, and regulations governing alcohol consumption, the use of entertainment districts or 'open-container zones' and what parameters are used to define permissions, which states are adopting 0.05 BAC DUI laws, and how Ready-to-Drink (RTD) products are defined in each state, and more!

The following dashboards reflect some of these trends that reflect the evolution of alcohol access and consumption, as well as the changing criminal landscape around intoxicated driving. 

 

Legend that relates to the Entertain District Permissions by State

Entertainment districts are designated areas where alcohol consumption is permitted, this dashboard shows how each state defines and permits such areas. Data is collected through legislative review of each state’s alcohol definitions and regulations. (Updated Nov 2025)

 

0.05% BAC DUI

This map displays whether each state has proposed or not proposed legislation to lower the BAC to 0.05% from 0.08% for a DUI, with the only state to successfully propose and pass this legislation being Utah. This data is collected though review of state legislation, media coverage, and state regulations. (Updated Nov 2025)

 

Ready-To-Drink (RTD) Beverages

Ready-To-Drink beverages (RTD) are single-serving alcoholic beverages that have recently grown in popularity and have carved out a unique place in the beverage marketplace. Most states define RTDs under their spirits category, however, there is a recent legislative movement to better define and create separate categories for RTDs amongst certain states to better regulate these increasingly popular goods, with an eye towards classification for taxation and retail purposes.
